1. Parties and Acceptance of the Agreement
These Terms and Conditions of Use (“Agreement”) have been entered into between SETAF2018 (“Provider”) and any individual or entity (“User”) who visits the setaf2018.com website or obtains a SETAF2018 software license. By using the Site or the Software, you are deemed to have accepted these terms.
2. Service and License Description
- SETAF2018 is professional software developed for civil and geotechnical engineering calculations, 3D modeling, slope stability analysis, shoring design, and reporting processes.
- The purchase does not grant the User a right of ownership; it grants a non-transferable, non-exclusive license to use the product that is valid for the term of the Agreement.
- Cracking the license, decompiling or reverse-engineering the source code, or unauthorized reproduction are strictly prohibited.
3. Sales and Billing (Merchant of Record)
Software orders and payment transactions are processed by our authorized reseller, Paddle.com Market Ltd. (“Paddle”), and iyzico. Paddle’s own Terms of Service also apply to the billing and collection processes.
4. Engineering and Analysis Liability (Important Disclaimer)
- SETAF2018 is a helpful and time-saving analysis tool for engineering calculations.
- All numerical analyses, drawings, quantity surveys, and reports generated by the software must be reviewed, verified, and approved by a qualified and licensed geotechnical or civil engineer.
- SETAF2018 cannot be held liable for any direct or indirect material or non-material damages resulting from errors that may arise at construction sites, in projects, or during groundwork applications, or from incomplete data entries, incorrect parameter definitions, or a lack of engineering judgment.
5. Intellectual Property Rights
The algorithms, interface designs, logos, documents, and all content on the SETAF2018 website are the property of SETAF2018 and are protected by international copyright laws.
6. Termination and Suspension
In the event of a breach of the terms of the agreement, the license terms, or intellectual property rights, SETAF2018 reserves the right to unilaterally and immediately revoke the User’s license.
7. Competent Court and Governing Law
In the event of any disputes arising from this Agreement, the laws of the Republic of Turkey shall apply, and the courts and enforcement offices of Istanbul shall have jurisdiction.
